What to Do If Your Company Refuses to Pay UIF in South Africa Though this issue is not Common but in some cases happen we have found Someone on facebook claiming about their Previous Employer Refuses to pay your UIF This page will guide what to do on situation like that.

What can I do if my ex employer has refused to give me my UI-19 form for five years?

Employers have to pay UIF if they have employees for more than 24 hours per month. If they are deducting it from your salary but not paying it, they could get in big trouble with SARS. They should also be deducting and paying PAYE. You can contact the UIF call centre to see if you are registered and if payments are being made.

If not, report your employer to the department of labour or sars.. ufiling.labour.gov.za/uif/ You can use that site to see if uif is being paid on your behalf if the employer deducts it, see if the employer is registered for UIF and report them if they are not. If you were dismissed, you would have been able to claim UIF. The documents you need to claim UIF are

  • A copy of 13-digit bar-coded identity document.

  • A copy of your last six payslips.

  • Information supplied by your employer (UI-19).

  • A service certificate from the employer.

  • Proof of registration as a work seeker.

  • A fully completed registration form.

Even though you have missed the opportunity to claim UIF in the twelve months after your employment, it may still be worth reporting the fact that your employer refused to give you the U1-19 form, which he was legally obliged to do. You would need to report it to the Department of Labour and they would despatch an inspector, provided they were willing to follow it up, after five years have gone by.

My employer refuses to pay me overtime.

To get started with this discussion I will first post the question I received from PL and then my E-Mail reply as I sent it off to him. I will then go slightly deeper into the options someone who is struggling with salary non-payment has.

Question: I have a problem with my company. They don’t pay us as it written on the contract. They don’t pay our overtimes. And i have about one year working for them. So i need my back pay money that they robbed me from day one. We requested meetings together with our management but we never got a reply. Please help us!

Answer: Hi PL,

I am sorry to hear about your problem. It is sad that an employer is taking advantage of staff during this difficult time.

Here’s what you need to do:

1) Firstly you need to try and discuss this matter with your employer. It sounds like you have already done this. I would recommend that you request the meeting in writing so that you have a record of your request. If your employer does meet with you try to discuss the issues in a calm and respectful manner. If your employer does not acknowledge your request or still refuses to pay after the meeting then you need to take it further.

2) You will need to contact the Dept of labour for assistance, not the CCMA. The Dept of labour should assign an investigator to contact the employer and investigate the non-payment. The great thing is this is free, so it will not cost you a thing.
